# Beta Test Terms and Conditions for PuzzleWorks Beta Program
**Effective Date: March 24, 2026
These Beta Test Terms and Conditions (“Terms”) govern your participation in the beta testing program (“Beta Program”) for PuzzleWorks (“App” or “Software”), operated by PuzzleWorks (“Company,” “we,” “us,” or “our”). By accessing, downloading, installing, or using the App in the Beta Program, you agree to be bound by these Terms. If you do not agree, do not participate.
## 1. Beta Program Overview
The Beta Program provides early access to pre-release versions of the App for testing purposes. The App may contain bugs, errors, incomplete features, and instability. Participation is voluntary and at your own risk.
## 2. Eligibility
- You must be at least 18 years old or the age of majority in your jurisdiction.
- You must have a compatible device and agree to provide truthful information during signup.
- Employees, contractors, and their immediate family of the Company may participate but are subject to the same Terms.
- We reserve the right to accept or reject any participant without explanation.
## 3. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App solely for beta testing during the Beta Program period. This license does not include rights to modify, reverse engineer, decompile, or distribute the App. All intellectual property rights remain with the Company.
## 4. Feedback and Reporting
- You agree to provide honest, detailed feedback, bug reports, suggestions, and usage data (“Feedback”) via designated channels (email, in-app forms, surveys, etc.).
- Feedback becomes our exclusive property. We may use it freely without compensation or attribution to you.
- You grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate your Feedback into the App or any products.
## 5. Data Collection and Privacy
- The App may collect usage data, crash reports, device information, location data (if enabled), and other telemetry to improve the Software.
- Your personal data is handled per our Privacy Policy [link], which is incorporated herein.
- By participating, you consent to such collection and sharing with our service providers for beta purposes.
- We may publicly acknowledge your participation unless you request anonymity, at which time that will be granted.
## 6. Confidentiality
- The App, its features, screenshots, documentation, and any non-public information disclosed to you are considered open public information. You may openly disclose your experience, screenshots, video and reviews.
- This obligation survives termination of the Beta Program.
## 7. No Warranties; As-Is Basis
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION.
We do not guarantee the App will be error-free, secure, or meet your requirements. Beta testing inherently involves risks of data loss, device malfunction, or security vulnerabilities.
## 8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE BETA PROGRAM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability shall not exceed $0 USD. This limitation applies regardless of the legal theory (contract, tort, etc.).
## 9. Indemnification
You agree to indemnify, defend, and hold harmless the Company from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from:
- Your use of the App,
- Your breach of these Terms,
- Any Feedback you provide that infringes third-party rights,
- Your violation of applicable laws.
## 10. Term and Termination
- The Beta Program begins upon your acceptance and ends on a date determined by us.
- We may terminate your participation immediately for any reason, including breach, without notice or liability.
- Upon termination, you must immediately cease use, uninstall the App, and destroy all copies and Confidential Information.
- Sections on Feedback, Confidentiality, No Warranties, Limitation of Liability, and Indemnification survive termination.
## 11. Risk Acknowledgment
You understand beta software may:
- Cause device crashes, data corruption, or security issues.
- Consume high battery, data, or processing resources.
- Include experimental features that change or disappear.
- Expose you to potential privacy risks from incomplete security.
You participate at your sole risk and waive any claims against us for damages resulting from beta use.
## 12. No Compensation
You receive no monetary compensation, equity, or other rewards for participation or Feedback unless separately agreed in writing.
## 13. Intellectual Property
- All rights in the App, including any patents, copyrights, trademarks, and trade secrets, belong solely to the Company.
- You acquire no ownership or rights except the limited license herein.
- Any improvements or derivative works based on your Feedback belong to us.
## 14. General Provisions
- **Governing Law**: These Terms are governed by the laws of [State/Country, e.g., Delaware, USA], without regard to conflict of laws principles. Disputes shall be resolved exclusively in courts located in Lincoln County, ME.
- **Entire Agreement**: These Terms constitute the full agreement and supersede prior understandings.
- **Severability**: If any provision is invalid, the remainder remains enforceable.
- **Waiver**: Failure to enforce a right does not waive it.
- **Assignment**: You may not assign these Terms; we may assign freely.
- **Changes**: We may update these Terms with notice via email or in-App. Continued participation constitutes acceptance.
- **No Partnership**: Participation does not create any agency, partnership, or joint venture.

**Appendix A: Additional Beta Tester Obligations**

**Appendix B: Acceptable Use Policy**
You agree not to:
- Use the App for illegal activities.
- Attempt to circumvent security measures or gain unauthorized access.
- Introduce malware, spam, or disruptive code.
- Harass other testers or Company staff.
- Upload offensive, illegal content or content not suitable for individuals 13 years or older.
**Appendix C: Ban Use Policy**
- Any forms of illegal content, images or otherwise non puzzle related content, may result in an immediate ban. Bans may be lifetime in duration and no ban adjudication is guaranteed.
**Beta Tester Acknowledgment Form**
- I understand the risks.
- I grant all Feedback rights as stated.
